1. Purpose
These Terms & Conditions of Sale (hereinafter “T&Cs”) govern the entirety of the contractual relations between New Black Cosmetics SAS and any natural person of legal age, not acting in a commercial capacity (hereinafter the “Customer”), making a purchase on the website newblackcosmetics.com (hereinafter the “Site”).
Any order placed on the Site implies the Customer’s full, complete and unreserved acceptance of these T&Cs. New Black Cosmetics reserves the right to amend these T&Cs at any time; the applicable T&Cs are those in force at the time the order is placed.

3. Definitions
- Customer: any natural person of legal age, acting as a consumer, placing an order on the Site.
- Product: any item (make-up, accessories, packs) offered for sale by New Black Cosmetics on the Site.
- Order: the Customer’s definitive contractual commitment to acquire one or more Products, validated by payment.
- Site: the website newblackcosmetics.com, its sub-domains and any mobile applications.
4. Products
The Products offered for sale are those displayed on the Site on the day of consultation, subject to available stock. The essential characteristics, composition and precautions for use of the Products are described on each product page.
The photographs, illustrations and videos showing the Products are for guidance only and are not contractual. Despite the care taken in their production, slight variations in colour or appearance may appear, in particular due to screen calibration.
In the event a Product is unavailable after the order is placed, New Black Cosmetics will inform the Customer as soon as possible and offer, at the Customer’s choice: waiting for the item to be restocked, replacement with an equivalent Product, or a full refund.
The Products are intended for the Customer’s personal use. Any resale is prohibited.
5. Prices
The prices of the Products are shown in euros (€), inclusive of all taxes, excluding delivery costs. They take into account the VAT applicable on the day of the order.
New Black Cosmetics reserves the right to amend its prices at any time. However, the Products will be invoiced on the basis of the rate in force at the time the order is confirmed, subject to availability.
Delivery costs are disclosed to the Customer before the final validation of the order and are charged in addition to the price of the Products (see Article 8).
6. Order
To place an order, the Customer selects the desired Products, adds them to the basket, enters their delivery and billing details, chooses a delivery and payment method, and then definitively validates the order.
Validation of the order constitutes acceptance of these T&Cs, the prices, the lead times and the delivery costs. The contract of sale is formed upon confirmation of the order by New Black Cosmetics, sent by email to the Customer.
New Black Cosmetics reserves the right to refuse or cancel any order in the event of: an existing dispute with the Customer, full or partial non-payment of a previous order, refusal of payment authorisation by the banking organisation, suspicion of fraud, or manifest stock shortage.
7. Payment
Payment is due immediately at the time of the order. The accepted payment methods are:
- Bank card (Carte Bleue, Visa, Mastercard, American Express) via Stripe
- Apple Pay and Google Pay via Stripe
- PayPal
- Instalment payment via PayPal (subject to the Customer’s eligibility with PayPal)
Payments by cheque or bank transfer are not accepted.
Transactions are secured by the 3D Secure protocol and SSL/TLS encryption. The Customer’s bank details are entered on the secure interface of the payment provider (Stripe or PayPal), certified PCI-DSS, and never pass through the servers of New Black Cosmetics, which does not retain them.
8. Delivery
8.1. Delivery area
The Products are currently delivered to Metropolitan France only. Any extension of the delivery area will be announced on the Site and incorporated into these T&Cs.
8.2. Delivery methods and costs
- Colissimo (home delivery): €3.95
- Mondial Relay (pickup point): €3.95
- Free delivery on orders of €50 or more, all methods combined
Delivery costs are shown before the final validation of the order. New Black Cosmetics reserves the right to adjust these rates at any time; the costs applicable to each order are those displayed at the time of validation.
8.3. Lead times
- Order preparation: within 24 working hours of payment confirmation.
- Transit: 48 to 72 working hours by Colissimo, 3 to 5 working days by Mondial Relay, subject to the carrier’s own lead times.
The indicated lead times are given as a guide. Any exceptional delay will be notified to the Customer. In accordance with Article L.216-2 of the French Consumer Code, in the event of failure by the seller to fulfil the delivery obligation by the agreed date or, failing that, within thirty (30) days of the conclusion of the contract, the Customer may terminate the contract if, after having put the seller on notice to make delivery within an additional reasonable period, the seller has not done so.
8.4. Address and receipt
Deliveries are made only to fixed addresses in Metropolitan France. Hotels, PO boxes, poste restante and non-fixed dwellings (campsites, mobile homes, etc.) are excluded.
It is the Customer’s responsibility to check the condition of the parcel on receipt and to raise any reservations with the carrier in the event of damage or shortfall. In the event of non-conformity of the Product(s) delivered, the Customer must inform New Black Cosmetics by email at [email protected] within fourteen (14) days of receipt, without prejudice to the statutory warranties (Article 11).
9. Transfer of ownership and risk
The Products remain the property of New Black Cosmetics until full and effective payment of the price, costs and taxes by the Customer (retention of title clause).
In accordance with Article L.216-4 of the French Consumer Code, the transfer of risk of loss or damage to the Products takes place upon the Customer taking physical possession of the Products.
10. Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without giving reasons and without incurring any penalty, with the exception of return costs which remain payable by the Customer.
Cosmetics exception — hygiene and health protection: in accordance with Article L.221-28, 5° of the French Consumer Code, the right of withdrawal cannot be exercised for cosmetic Products that have been opened, unsealed or used after delivery and which cannot be returned for reasons of hygiene or health protection.

11. Statutory warranties
All Products offered by New Black Cosmetics benefit from the following statutory warranties, independently of any commercial warranty:
- Statutory warranty of conformity (Articles L.217-3 to L.217-17 of the French Consumer Code): New Black Cosmetics is liable for any lack of conformity of the Product for a period of two (2) years from delivery.
- Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may decide to invoke the warranty against hidden defects of the item sold, within two (2) years from discovery of the defect.
To invoke one of these warranties, the Customer should send a request to [email protected], together with proof of purchase, specifying the nature of the defect identified.
12. Customer account
Creating a customer account allows the Customer to access their order history, their saved addresses and to streamline their future orders. The account is strictly personal.
The Customer is solely responsible for the confidentiality of their username and password. Any action taken from their account is deemed to have been carried out by them. If the Customer suspects fraudulent use of their account, they must immediately inform New Black Cosmetics.
The Customer undertakes to provide accurate information when creating and updating their account.
13. Personal data
The personal data collected by New Black Cosmetics under these T&Cs are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.
The arrangements for collecting, processing and retaining data, together with the Customer’s rights over their data, are detailed in our Privacy Policy.
14. Intellectual property
All elements appearing on the Site (text, images, logos, videos, trade marks, graphic identity, source code) are the exclusive property of New Black Cosmetics SAS or its licensors. The “New Black” trade mark is a registered trade mark.
Any reproduction, representation or exploitation, in whole or in part, of these elements without prior written authorisation is strictly prohibited and constitutes infringement. See our Legal Notice.
15. Liability
New Black Cosmetics is bound by a best-endeavours obligation in supplying its Products and services. Its liability cannot be incurred:
- In the event of misuse of the Products by the Customer (failure to observe the precautions for use indicated);
- In the event of indirect damage resulting from use of the Site (loss of data, service interruption, computer virus, etc.);
- In the event of force majeure (Article 16) or the act of a third party.
16. Force majeure
New Black Cosmetics cannot be held liable for any delay or non-performance of its obligations resulting from an event of force majeure, as defined by Article 1218 of the French Civil Code: general strike, natural disaster, pandemic, interruption of telecommunications or energy networks, governmental restrictions or any other event beyond its reasonable control.
17. Complaints and mediation
For any complaint, the Customer may contact New Black Cosmetics’ customer service by email at [email protected]. We undertake to respond within forty-eight (48) working hours.
In accordance with Articles L.611-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably, the Customer may have free recourse to the consumer mediator appointed by New Black Cosmetics:

18. Governing law and competent jurisdiction
These T&Cs are governed by French law. In the event of a dispute that could not be resolved amicably or through mediation, the French courts shall have sole jurisdiction, in compliance with the jurisdictional rules applicable to consumers, in accordance with Article R.631-3 of the French Consumer Code.
