Terms and Conditions

1. Purpose

These Terms and Conditions (hereinafter “T&Cs”) govern all contractual relations between New Black Cosmetics SAS and any natural person of legal age, acting as a non-trader (hereinafter the “Customer”), making a purchase on the website newblackcosmetics.com (hereinafter the “Site”).

Any order placed on the Site implies full and unreserved acceptance of these T&Cs by the Customer. New Black Cosmetics reserves the right to modify these T&Cs at any time, the applicable T&Cs being those in force at the time of the order.

3. Definitions

  • Customer: any natural person of legal age, acting as a consumer, placing an order on the Site.
  • Product: any item (makeup, accessories, sets) offered for sale by New Black Cosmetics on the Site.
  • Order: definitive contractual commitment of the Customer to acquire one or more Products, validated by payment.
  • Site: the website newblackcosmetics.com, its subdomains and any mobile applications.

4. Products

The Products offered for sale are those displayed on the Site on the day of consultation, within the limits of available stock. The essential characteristics, composition and precautions for use of the Products are described on each product page.

Photographs, illustrations and videos presenting the Products are for information only and are not contractual. Despite the care taken in their production, slight variations in color or appearance may appear, notably due to screen calibration.

In the event of unavailability of a Product after an order, New Black Cosmetics will inform the Customer as soon as possible and offer, at their choice: to wait for restocking, replacement with an equivalent Product, or a full refund.

The Products are intended for personal use by the Customer. Any resale is prohibited.

5. Prices

Product prices are indicated in euros (EUR), all taxes included (incl. VAT), excluding delivery fees. They take into account the VAT applicable on the day of the order.

New Black Cosmetics reserves the right to modify its prices at any time. However, Products are invoiced based on the rate in force at the time the order is validated, subject to availability.

Delivery fees are indicated to the Customer before final validation of the order and are charged in addition to the price of the Products (see Article 8).

6. Orders

To place an order, the Customer selects the desired Products, adds them to the cart, fills in their delivery and billing details, chooses their delivery and payment method, then definitively validates their order.

Validation of the order implies acceptance of these T&Cs, prices, deadlines and delivery fees. The sales contract is formed upon confirmation of the order by New Black Cosmetics, sent by email to the Customer.

New Black Cosmetics reserves the right to refuse or cancel any order in case of: existing dispute with the Customer, total or partial non-payment of a previous order, refusal of payment authorization by the banking organization, suspicion of fraud, or obvious stock shortage.

7. Payment

Payment is due immediately upon order. The accepted payment methods are:

  • Credit card (Carte Bleue, Visa, Mastercard, American Express) via Stripe
  • Apple Pay and Google Pay via Stripe
  • PayPal
  • Pay-in-installments via PayPal (subject to the Customer’s eligibility by PayPal)

Payments by check or bank transfer are not accepted.

Transactions are secured by the 3D Secure protocol and SSL/TLS encryption. The Customer’s banking details are entered on the secure interface of the payment provider (Stripe or PayPal), certified PCI-DSS, and never pass through New Black Cosmetics’ servers, which do not retain them.

8. Delivery

8.1. Delivery Area

Products are currently delivered to mainland France only. Any extension of the delivery area will be announced on the Site and integrated into these T&Cs.

8.2. Delivery Methods and Fees

  • Colissimo (home delivery): EUR 3.95
  • Mondial Relay (pickup point): EUR 3.95
  • Free delivery on orders of EUR 50 or more, all methods combined

Delivery fees are indicated before final validation of the order. New Black Cosmetics reserves the right to adjust these rates at any time; the fees applicable to each order are those displayed at the time of validation.

8.3. Lead Times

  • Order preparation: within 24 business hours of payment confirmation.
  • Shipping: 48 to 72 business hours by Colissimo, 3 to 5 business days by Mondial Relay, subject to the carrier’s own deadlines.

The indicated lead times are communicated for information only. Any exceptional delay will be reported to the Customer. Pursuant to Article L.216-2 of the French Consumer Code, in the event of failure by the seller to deliver on the agreed date or, failing that, within thirty (30) days following the conclusion of the contract, the Customer may terminate the contract if, after having put the seller on notice to deliver within an additional reasonable period, the latter has not complied.

8.4. Address and Receipt

Deliveries are made only to fixed addresses in mainland France. Hotels, P.O. boxes, poste restante and non-fixed residences (campsites, mobile homes, etc.) are excluded.

It is the Customer’s responsibility to check the condition of the package upon receipt and to make any reservations with the carrier in case of damage or missing items. In the event of non-conformity of the delivered Product(s), the Customer must inform New Black Cosmetics by email at [email protected] within fourteen (14) days of receipt, without prejudice to legal warranties (Article 11).

9. Transfer of Ownership and Risk

The Products remain the property of New Black Cosmetics until full and effective payment of the price, fees and taxes by the Customer (retention of title clause).

Pursuant to Article L.216-4 of the French Consumer Code, the transfer of risks of loss or damage to the Products occurs at the moment of physical possession of the Products by the Customer.

10. Right of Withdrawal

Pursuant to Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from the receipt of the Products to exercise their right of withdrawal, without having to justify a reason or pay penalties, except for return shipping fees, which remain at their expense.

Cosmetic exception — hygiene and health protection: pursuant to Article L.221-28, 5 of the French Consumer Code, the right of withdrawal cannot be exercised for cosmetic Products that have been opened, unsealed or used after delivery and that cannot be returned for reasons of hygiene or health protection.

11. Legal Warranties

All Products offered by New Black Cosmetics benefit from the following legal warranties, independent of any commercial warranty:

  • Legal warranty of conformity (Articles L.217-3 to L.217-17 of the French Consumer Code): New Black Cosmetics is liable for any lack of conformity of the Product for a period of two (2) years from its delivery.
  • Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may decide to invoke the warranty against hidden defects of the item sold, within a period of two (2) years from the discovery of the defect.

To invoke one of these warranties, the Customer sends their request to [email protected], accompanied by the proof of purchase, specifying the nature of the defect identified.

12. Customer Account

The creation of a customer account allows the Customer to find their order history and saved addresses, and to simplify their future orders. The account is strictly personal.

The Customer is solely responsible for the confidentiality of their username and password. Any action taken from their account is deemed to have been taken by them. In the event of suspected fraudulent use of their account, the Customer must immediately inform New Black Cosmetics.

The Customer undertakes to provide accurate information when creating and updating their account.

13. Personal Data

Personal data collected by New Black Cosmetics under these T&Cs is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertes).

The terms of collection, processing, retention and the Customer’s rights over their data are detailed in our Privacy Policy.

14. Intellectual Property

All elements appearing on the Site (texts, images, logos, videos, trademarks, graphic charter, source code) are the exclusive property of New Black Cosmetics SAS or its rights holders. The “New Black” trademark is a registered trademark.

Any reproduction, representation or exploitation, in whole or in part, of these elements without prior written authorization is strictly prohibited and constitutes infringement. See our Legal Notice.

15. Liability

New Black Cosmetics is bound by an obligation of means in the provision of its Products and services. Its liability cannot be engaged:

  • In the event of misuse of the Products by the Customer (non-compliance with the precautions for use indicated);
  • In the event of indirect damage resulting from use of the Site (loss of data, service interruption, computer virus, etc.);
  • In the event of force majeure (Article 16) or third-party action.

16. Force Majeure

New Black Cosmetics cannot be held responsible for any delay or non-performance of its obligations resulting from a case of force majeure, as defined by Article 1218 of the French Civil Code: general strike, natural disaster, pandemic, interruption of telecommunications or energy networks, governmental restrictions or any other event beyond its reasonable control.

17. Complaints and Mediation

For any complaint, the Customer may contact the New Black Cosmetics customer service by email at [email protected]. We commit to responding within forty-eight (48) business hours.

Pursuant to Articles L.611-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably, the Customer may recourse free of charge to the consumer mediator designated by New Black Cosmetics:

18. Applicable Law and Jurisdiction

These T&Cs are governed by French law. In the event of a dispute that could not be resolved amicably or through mediation, the French courts shall have sole jurisdiction, in compliance with the rules of jurisdiction applicable to consumers, pursuant to Article R.631-3 of the French Consumer Code.
